Terms & Conditions
Contract for services supplied by Jeremy Sargent Photography, Trading as Hampshire Property Photography
The purpose of this document is to form an agreement between Hampshire Property Photography/Jeremy Sargent Photography and Their Clients
DEFINITIONS
• “The Photographer” means Jeremy Sargent Trading As Hampshire Property Photography/Jeremy Sargent Photography or any Professional Photographer Working for or at Hampshire Property Photography.
• “The Client” is the party commissioning the Photographer and includes the Client’s affiliates, assignees, and successors in title.
• “Assignment” means a commission by the Client of the Photographer for provision of Photographic services at a shoot for the purpose of creating Material for Marketing Purposes.
• “Quote” means any email or other document electronic or otherwise created by the Photographer and setting out the Fee and expenses for any Assignment along with information as to Usage Licences.
• “Fee” means the Photographer’s fees as set out in the Quote.
• “Image Licence” means the still and/or moving images selected from the Material and as specified in the Quote as to be licensed for use in accordance with these Terms.
• “Material” means all photographic material created by the Photographer pursuant to an Assignment and includes but is not limited to transparencies, negatives, prints, digital files or any other type of physical or electronic material recording either still or moving images.
• “Shoot Duration” means the number of confirmed days of a shoot whether undertaken consecutively or in separate parts and includes all shoot, travel, recce, preparation or test days.
• “Usage Licence” means the licence to use the Licensed Images as set out in clauses below.
• “Working Hours” Means any day that is not a Saturday or Sunday or UK Bank Holiday in England. Between the Hours of 9am and 4pm.
APPLICATION OF TERMS
The Booking of an appointment for our Professional Photography, Elevated Photography (and other services) by The Client and the acceptance of the said booking by The Photographer confirms all parties have read & agree to the terms set out below. These terms and conditions will:
• Apply to all Assignments undertaken by The Photographer for The Client and to all Usage Licences or extended and/or additional Usage Licences relating to such Assignments; and
• Prevail over any inconsistent terms or conditions contained, or referred to, in The Client’s purchase order, confirmation of order, acceptance of Estimate, or specification or other document supplied by The Client, or implied by law, trade custom, practice or course of dealing
SERVICES AND DELIVERABLES
RESIDENTIAL PROPERTY PHOTOGRAPHY ASSIGNEMENTS
For each property shoot, an attempt will be made to photograph:
• 2 or more shots of the front elevation to show
o The frontage of the building at street level straight on and
o At an angle to show depth and any applicable driveway and accompanying garage/outbuilding
• 2 or more shots of garden at minimum
o 1 facing away from property,
o 1 shot of rear garden facing property.
• 1 or more shot/s of Kitchen.
• 1 or more shots of any utility room
• 1 or more shots of the Lounge area
• 1 or more shots of master bedroom and 1 or more shots of any en-suite if applicable
• 1 shot of each bedroom
• 1 shot of family bathroom
• PLEASE NOTE –
o Downstairs toilets, upper and lower hallways/landings will always, by default not be photographed unless specifically requested or if deemed it will add to the appeal of the property
o Garages and outbuildings (internally) will also be photographed on request.
o High level or elevated photography are deemed an additional service and should be booked as such at an additional cost.
EXTERNAL AND INTERNAL ASSIGMENTS + ELEVATED PHOTOGRAPHY (EXCLUDING DRONE)
Will usually Yield and an additional 2 – 3 Images utilising a 30ft Pole… PLEASE NOTE, this service is subject to additional fees (to be arranged) and is subject to a brief on site risk assessment and as such subject to cancellation at the Photographers discretion.
DUSK/TWIGHLIGHT PHOTOGRAPHY:
This service is usually for External shots on Properties that have had extensive detailing applied to exterior lighting. However, can also be applied to and utilised to shoot the interiors of specific rooms that may have impressive outlooks through Bi-Fold doors etc. PLEASE NOTE, this service is subject to additional fees (to be arranged) but due to the anti-social hour requirements, is usually equal to a 50% of the original shoot cost.
MATTERPORT & 360 VIRTUAL TOURS:
This service provides a deep dive and intimate level of viewing to the property, as such The Client and Homeowner are liable to ensure the property is prepared (prior to the shoot) to their satisfaction taking into account following Privacy and GDPR touch points
• Personal photos are removed from view
• ALL Personal and sensitive information is removed from view
• ALL valuables such as (but not limited to) Watches and Jewellery, The location of car keys, Fine Art items and any high end ‘tech’ are hidden/covered/removed from view.
FLOORPLANS:
• Floorplans are for illustrative and guidance purposes only. Although a laser measure is used measurements and areas shown are approximate to within 5cm. We will aim to provide plans that are accurate and correctly represent the rooms within the property. We do not, however, provide any guarantees, warranty or representation as to the total accuracy and completeness of the floorplan, as such, our floorplans should not be used for valuation purposes. Anyone relying on the information provided in the property details (and floorplans) should conduct a careful, independent investigation of the property to determine the suitability of the property for their requirements. Any future amendments to the structure that will require floorplan amendments will incur additional costs. PLEASE NOTE, this service will Incur additional fees to be arranged
DRONE PHOTOGRAPHY
• Subject to separate Terms and Conditions
DELIVERY OF SERVICE/CONTENT:
• Images will be sent digitally via WeTransfer or other pre agreed form within 48 hours of the shoot taking place. Images will be edited to give a bright but natural representation of the property.
COPYRIGHT, IMAGE LICENCING, NON-USE OF CONTENT
& PHOTOGRAPHER USE
COPYRIGHT:
The Photographer retains the full worldwide copyright of all images taken. The Photographer reserves the right to use images for self-promotion, editorial use, on personal website and social media, unless instructed by or negotiated in a separate contract with the agent or end user / vendor.
IMAGE LICENCE:
The Client alone is hereby granted unlimited usage rights (across their brand and marketing channels only) of the images created on their assignments for their Sole Marketing Purposes and are only permitted to use the images as outlined in the contract that is either in force or will be sent after booking confirmation. Both The Photographer and The Client are forbidden from ‘selling’ or ‘gifting’ the images to any other third party without expressed written consent from all parties.
NON-USE OF WORK:
Should Photographs be delivered to The Client, but then not used, or, The property is removed from market after the shoot has been completed but prior to The Client receiving Photographs from The Photographer, The Client is still liable for the full shoot Fee
PHOTOGRAPHERS USE:
The Photographer retains the right in all cases to use the Photographs at any time for the purposes of promoting his/her work. If you wish to request an NDA (Non-Disclosure Agreement, please put this in writing to The Photographer prior to the shoot.

BOOKING, CANCELLATIONS, ABBORTIVE VISITS,
PRICING & PAYMENTS
BOOKING
Once an appointment has been booked into our diary it becomes subject to these terms and conditions.
CANCELLATIONS:
Any Assignment cancelled within 24hrs will be subject to a cancellation fee equal to 50% of the agreed price.
ABORTIVE VISITS:
If the property is unattended and keys are issued for a lone visit and the property is, in our opinion in a non-photographic state, The Photographer will make every effort to communicate the situation with The Client to gain comments on how to proceed. In the event The Photographer cannot contact The Client, the photoshoot will be completed, unless otherwise advised when confirming a booking. If the assignment is aborted 50% of the full fee is payable by The Client. If The Client gives the go ahead and/or the photoshoot is completed, and is then not happy with the results, the full will remain payable and The Client will need to rebook a fresh shoot at full price.
PRICING:
The pricing structure is inclusive of the creative rates of The Photographer as well as industry standard photography licence rates, these rates are adjusted periodically, and future pricing may increase with 30 Days notice.
PAYMENT:
For new Clients, a 50% Non-refundable deposit Fee is required to secure the booking. Once the Assignment has been completed, the remaining balance is required prior to the release of the high res images.
For ongoing Clients an invoice will be created and sent at the end of the Month, Payment is then required within 30 Days.
WORKING ENVIROMENT, INDEMNIFICATION AND SAFETY
OCCUPIED HOMES:
In the event, The Client requires The Photographer to attend an occupied home the following terms will become applicable.
WORKING ENVIRONMENT:
It is beneficial for all parties concerned to have a clear working environment, please make sure any trip hazards are moved or clearly marked and that all pets are either not present or away from the current working areas. We are dog friendly but do not wish to be jumped on or expensive equipment being knocked over, as such The Photographer reserves the right to refuse to proceed should they consider it unsafe to do so. All our equipment is insured for business use however if The Client/ Home Owner/Keyholder or other persons / pets present cause accidental damage we will invoice for 25% of the replacement costs. Should The Photographer sustain any injury due to an act of aggression from a pet at a property, legal advice will be sought against the owners.
INDEMNIFICATION:
The Client will indemnify and defend The Photographer against all claims, liability, damages, costs, and expenses, including reasonable legal fees and expenses, arising out of the creation of/or any use of the photos or materials furnished by Property Owner. It is The Clients responsibility to obtain the necessary Signed Model & Property releases forms to ensure they are in full effect and in force. This is in relation to GDPR (General Data Protection Regulation) where family photos or other identifying information is captured within the images, these images will be online for the world to see, so should not contain images of children who may be subject to any protection orders, or cause distress or offence to those who are the subject within images.
MINOR’S & VULNERBALE ADULTS (UNDER 18’S):
We will NOT work alone with minors or vulnerable adults in the property, if minors or vulnerable adults are present then they must always be accompanied by a Responsible Parent/Guardian. In the event that a minor or vulnerable adults is left alone at any time we will not work on that floor/level until either the Responsible Parent/Guardian is present, or the minor has moved to a different floor. If a property is empty and a minor or vulnerable adults arrives home by themselves, we will Immediately leave and inform The Client and any key holder of the situation. Any such scenario will be classified as an Abortive Visit and subject to 50% of the Agreed fee will be payable by The Client.
SHOOT PREPERATION
PREPERATION / STAGING THE PROPERTY/SITE:
In the event The Client requires The Photographer to attend an occupied home, it is The Clients responsibility to ensure the property is staged to their requirements, A ‘Staging Guide’ to prepare the property to its best can be provided via email upon request.
PREPARATION ASSISTANCE:
While we give final (pre shoot) suggestions to any staging that has been carried out by others, the Photographer takes no responsibility for the property presentation when we arrive and will shoot as presented. As we are on strict time restraints and insurance restrictions, we are unable to move large amounts of items to improve any particular shots. We will move tea towels and bins and basic washing items from the kitchen and wheelie bins from the front of the property. For sanitary reasons bathroom towels and items will not be touched. It is therefore strongly recommended to spend some time prior to our attendance to check the property is properly presented to fully guarantee the images received are of the highest presentation possible. If staging help is required because ‘The Client’ has limited ability this can be arranged as a separate service via our preferred suppliers (Link to Portfolio available upon request) If the home owner does not wish to stage their own home, The Client shall be responsible for staging the home so as to obtain their desired photographic staging standards, including (but not limited to) specifying locations to be photographed and taking time to prepare the locations to be photographed prior to The Photographers arrival. The Photographer shall not be responsible for photographs not taken as a result of The Client’s/Homeowners failure to provide reasonable assistance or cooperation. In the absence of prior instructions or specific requests, the photographs recorded and provided will be totally at The Photographers discretion.
FAILURE TO PERFORM:
If The Photographer or any subcontractor (excluding ‘Preferred/Partnered Suppliers’ who have entered into a separate and direct agreement with The Client) cannot complete the assignment booked due to sickness, travel disruption, casualty, fire, acts of nature restricted access, restrictions on the use of photography within a specified area or other causes beyond the control of other parties then The Photographer will have no liability with respect to the assignment. The Photographer is not liable if bad weather, poor lighting, access restrictions, lack of compliance from third party subjects or other peripheral factors adversely affect the quality of the service delivered. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, stolen, lost in the mail or otherwise lost or damaged without fault of The Photographer or any subcontractor working on behalf of Hampshire property Photography. In the event The Photographer fails to perform the assignment as directed for any other reason they shall not be liable for any amount beyond that of the fees agreed for the failed assignment.
TRAVEL FEES:
Unless otherwise agreed in writing in advance travel fees will be added to the final invoice at a rate of £1.10 per mile for anything over 15 miles away from SO40 8, this cost is calculated at the base rate of 45p per mile for basic fuel and vehicle costs plus 65p per mile where time per minute is calculated to be equal to an hourly rate while travelling at 60mph.
OTHER SERVICES
HOME STAGING:
We have partnered with a reputable local home stager who can offer multiple levels of service from complete ‘Home Staging’ to ‘Photo Dress’. More details upon request, this service is subject to additional fees to be arranged with our partnered Home Stager. Please note, this service could also attract additional timescales out of the control of The Photographer.
PLEASE NOTE: The Home staging service is offered by a 3rd party, Therefore, on arrival The Photographer will assume that The Client is happy with the service provided by The Home Stager and as such, that the Photography is to go ahead on their arrival. Therefore, it is The Clients responsibility to ensure they are happy with the service provided ahead of The Photographers booked appointment. The Photographer cannot be held liable for any concerns over the quality of the home staging service.

The Photographer is not liable if bad weather, poor lighting, access restrictions, lack of compliance from third party subjects or other peripheral factors adversely affect the quality of the service delivered. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, stolen, lost in the mail or otherwise lost or damaged without fault of The Photographer or any subcontractor working on behalf of Hampshire property Photography. In the event The Photographer fails to perform the assignment as directed for any other reason they shall not be liable for any amount beyond that of the fees agreed for the failed assignment.
TRAVEL FEES:
Unless otherwise agreed in writing in advance travel fees will be added to the final invoice at a rate of £1.10 per mile for anything over 15 miles away from SO40 8, this cost is calculated at the base rate of 45p per mile for basic fuel and vehicle costs plus 65p per mile where time per minute is calculated to be equal to an hourly rate while travelling at 60mph.
OTHER SERVICES
HOME STAGING:
We have partnered with a reputable local home stager who can offer multiple levels of service from complete ‘Home Staging’ to ‘Photo Dress’. More details upon request, this service is subject to additional fees to be arranged with our partnered Home Stager. Please note, this service could also attract additional timescales out of the control of The Photographer.
PLEASE NOTE: The Home staging service is offered by a 3rd party, Therefore, on arrival The Photographer will assume that The Client is happy with the service provided by The Home Stager and as such, that the Photography is to go ahead on their arrival. Therefore, it is The Clients responsibility to ensure they are happy with the service provided ahead of The Photographers booked appointment. The Photographer cannot be held liable for any concerns over the quality of the home staging service.

No data is sold or passed to third parties without you the clients expressed written permission. Any data collected and stored using third party companies are documented below along with links to their privacy policies. All third parties are used because they adhere to GDPR rules and regulations.
2) Data is collected by Jeremy Sargent Photography / Hampshire Property Photography and is done so via a contact button which will open your default browser where you may choose what information to share as you would in any email
3) Any email sent and its contents are viewed and stored via the internet using the Google Chrome Browser. Any replies to emails sent that show the original data you sent when downloaded to your own device fall outside of Jeremy Sargent Photography / Hampshire Property Photography’s control and security of such forms and information within such as Jeremy Sargent Photography / Hampshire Property Photography’s personal data will then fall under your own privacy policy compliance as appropriate.
4) Images and other digital marketing material are stored locally in the Lightroom editing software with Virus Barrier software and then backed up each month on an encrypted password-protected external hard drive which is then locked up in storage. The images are grouped and linked by the first line of property address, property name, or company name.
5) Payment is accepted via direct bank transfer or cash.
No card information or bank details are taken or held by Jeremy Sargent Photography / Hampshire Property Photography. They are dealt with by Santander. Their privacy policies are linked below
• Quick Books software will generate a transaction code along with a clients name who have paid using Paypal or stripe.
• Santander will pay reference to a payers account name and any reference they have attached on Jeremy Sargent Photography / Hampshire Property Photography statements.
6) Whilst Jeremy Sargent Photography / Hampshire Property Photography will attach no personal data to images in a public domain other than files which may be named for reference as the property name or street name and number, it is important that clients understand their responsibility to protect their personal privacy while the images are being taken.
Jeremy Sargent Photography / Hampshire Property Photography will always blank any car registration plates which may appear in the images. Clients agree that they will remove any personal images or persons which may cause them to be identified in the images from the areas being photographed prior to Jeremy Sargent Photography / Hampshire Property Photography arrival. Jeremy Sargent Photography / Hampshire Property Photography will check during a walk around and discuss family photos and other personal data he sees with you. By leaving or failing to mention to Jeremy Sargent Photography / Hampshire Property Photography before the photos are taken and upon proofing all items which may appear in the images the client is agreeing they are happy for them to be featured in the public domain.
Jpg final images may be referenced to within Light Room software against the appropriate client information. These images are only referenced locally on the computer.
Original image files may contain personal data which is later blanked out. These original files are stored locally as described above but may be entirely deleted upon request.
7) By allowing Jeremy Sargent Photography / Hampshire Property Photography to photograph you are agreeing that he may use the images for promotional and marketing material on his website and social media feeds with your permission. If you do not wish these images to be shared in such a way you must mention to him at the time of the shoot. However he will check with the paying client before anything is posted, you have the right to ask him not to use the images online and withdraw this permission. It is important to know that Jeremy Sargent Photography / Hampshire Property Photography will in no way ever knowingly post in the public domain any material that may be linked to someone’s identity. This includes images that feature persons who currently reside in that property. He may however feature paintings and other artworks which may complement the shot. The photographer unless otherwise stated always retains the copyright to the images.
8) Jeremy Sargent Photography / Hampshire Property Photography uses ‘in the very least’ 2 step login verification for the following data collecting services:

9) You have the right to be forgotten, and upon any such request from the party in question Jeremy Sargent Photography / Hampshire Property Photography will delete any records he has on that client. It is important to realise that whilst Jeremy Sargent Photography / Hampshire Property Photography is able to delete contact details, and images. It is not possible to delete payment transactions as these records may be required by the HMRC. Records can also not be deleted if they relate to overdue or unpaid invoices.
